Common use of Subsequent Demand for Excess Product Inventory Clause in Contracts

Subsequent Demand for Excess Product Inventory. If demand for Contractor’s Product(s) develops during the subsequent six-month period following the determination that excess product inventory exists which would consume all or a portion of the excess Die, Contractor shall use the excess Product inventory to fulfill such demand for Product. In this case, Contractor agrees to purchase back Company owned excess Product needed to fulfill the new demand at the same price Company paid Contractor as defined in paragraph 8.6.3 above before manufacturing new product to fulfill Company Purchase Order(s).
