Subsequent Failure. The procedure set forth in paragraph 1 shall apply to subsequent failure to comply with the testing requirements of the Executive Orders such as a discontinuation of required weekly testing, where applicable. In such case, employees deemed non-compliant based upon the records shown in the Wellspark system shall receive notice providing at least two days of opportunity to demonstrate vaccinated status and/or compliance with the weekly testing requirements of the Executive Orders, if applicable.
