Substitution Requested by the CNH Clause Samples
The "Substitution Requested by the CNH" clause allows the CNH (likely a regulatory authority or contracting party) to request the replacement of a party, asset, or component involved in the agreement. In practice, this means that if the CNH determines that a particular contractor, subcontractor, or piece of equipment is unsuitable or non-compliant, it can formally require the contracting party to provide an acceptable substitute within a specified timeframe. This clause ensures that the CNH maintains oversight and quality control over the project or contractual relationship, addressing issues of performance or compliance by enabling timely and effective substitutions.
Substitution Requested by the CNH. Prior to the termination of this Contract for any reason, including the rescission, the CNH may request that the Contractor refrain from conducting specific Abandonment activities regarding certain facilities, including ▇▇▇▇▇. In such case, the Contractor shall deliver the facilities in good working order to the third party designated by the CNH, and deliver any remaining balance in the Abandonment Trust to the Fund, and the Contractor thereafter shall be deemed to have been relieved of any future obligation related to the use and Abandonment of such facilities.
