Common use of Successful Defense Clause in Contracts

Successful Defense. To the extent that an indemnitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section (1) of this Article VI, or in defense of any claim, issue or matter therein, he shall be indemnified against expenses (including, without limitation, attorneys’ fees) actually and reasonably incurred by him in connection therewith.

Successful Defense. To the extent that an indemnitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section (1) 1 of this Article VIVII, or in defense of any claim, issue or matter therein, he or she shall be indemnified against expenses (including, without limitation, attorneys’ fees) actually and reasonably incurred by him or her in connection therewith.

Successful Defense. To the extent that an indemnitee the Indemnitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section (1Sections 1(a) of this Article VIand 1(b), or in defense of any claim, issue or matter therein, he shall be indemnified against expenses (including, without limitation, including attorneys’ ' fees) actually and reasonably incurred by him such person in connection therewith.

Successful Defense. To the extent that an indemnitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section (1) of this Article VI10.2(a), or in defense of any claim, issue or matter therein, he shall be indemnified against expenses (including, without limitation, attorneys’ fees) actually and reasonably incurred by him in connection therewith.

Successful Defense. To the extent that an indemnitee Indenmitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section subsections (1a) and (b) of this Article VISection 7.1, or in defense of any claim, issue or matter therein, he such person shall be indemnified against expenses (including, without limitation, including attorneys’ ' fees) actually and reasonably incurred by him such person in connection therewith.

Successful Defense. To the extent that an indemnitee has been successful on the merits or otherwise in defense of any action, suit or proceeding referred to in Section (1) 1 of this Article VIIV, or in defense of any claim, issue or matter therein, he or she shall be indemnified against expenses (including, without limitation, attorneys’ fees) actually and reasonably incurred or suffered by him or her in connection therewith.

Successful Defense.
