Common use of Successor Trustee by Xxxxxx, etc Clause in Contracts

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Person, the resulting, surviving or transferee Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, be the successor Trustee.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Person, the resulting, surviving or transferee Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, be the successor Trustee; provided that such Person shall be otherwise qualified and eligible under this Article Eight.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Personcorporation, the resulting, surviving or transferee Person corporation without any further act shall, if such resulting, surviving or transferee Person corporation is otherwise eligible hereunder, be the successor Trustee; provided, however, that such corporation shall be otherwise qualified and eligible under this Article Seven.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business (including this transaction) to, another Personcorporation, the resulting, surviving or transferee Person corporation without any further act shall, if such resulting, surviving or transferee Person corporation is otherwise eligible hereunder, be the successor Trustee; provided that such corporation shall be otherwise qualified and eligible under this Article 8.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates withconsolidates, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Person, the resulting, surviving or transferee successor Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee; provided, however, such Person shall be otherwise eligible and qualified under this Article and in accordance with any applicable rules or regulations of Gaming Authorities.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates withor any Agent consolidates, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Person, the resulting, surviving or transferee successor Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor TrusteeTrustee or any Agent, as applicable.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business assets to, another Person, the resulting, surviving or transferee Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business assets to, another Personcorporation, the resulting, surviving or transferee Person corporation, without any further act shallact, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee, provided such transferee corporation shall qualify and be eligible under Section 9.10.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Person, Person the resulting, surviving or transferee Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, be the successor Trustee; provided, however, that such Person shall be otherwise qualified and eligible under this Article Seven.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business to, another Personcorporation, the resulting, surviving or transferee Person corporation without any further act shall, if such resulting, surviving or transferee Person corporation is otherwise eligible hereunder, be the successor Trustee; provided , however , that such corporation shall be otherwise qualified and eligible under this Article Seven.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates withconsolidates, merges or converts with or into, or transfers or sells all or substantially all of its corporate trust business to, another Person, the resulting, surviving or transferee successor Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee, subject to Section 7.10.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates with, merges or converts with or into, or transfers all or substantially all of its corporate trust business assets (by sale or otherwise) to, another Personcorporation, the resulting, surviving or transferee Person corporation, without any further act shallact, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee, provided such transferee corporation shall qualify and be eligible under Section 9.

Successor Trustee by Xxxxxx, etc. If the Trustee consolidates withconsolidates, merges or converts with or into, or transfers all or substantially all of its corporate trust business or assets to, another Person, the resulting, surviving surviving, transferee or transferee successor Person without any further act shall, if such resulting, surviving or transferee Person is otherwise eligible hereunder, shall be the successor Trustee.
