Common use of Successor Trustee by Xxxxxx Clause in Contracts

Successor Trustee by Xxxxxx. If the Trustee consolidates with, merges or converts into, or transfers all or substantially all its corporate trust business or assets to, another corporation, the resulting, surviving or transferee corporation without any further act shall be the successor Trustee.

If the Trustee consolidates with, merges or converts into, or transfers all or substantially all its corporate trust business or assets (including this Trusteeship) to, another corporation, the resulting, surviving or transferee corporation without any further act shall shall, with the concurrence of the Company, be the successor Trustee.

If the Trustee consolidates with, merges or converts into, or transfers all or substantially all of its corporate trust business or assets (including the administration of this Indenture) to, another corporationcorporation or national banking association, the resulting, surviving or transferee corporation or national banking association without any further act shall will be the successor TrusteeTrustee with the same effect as if the successor Trustee had been named as the Trustee in the Indenture.
