Common use of Successor Trustee by Xxxxxx Clause in Contracts

Successor Trustee by Xxxxxx. If the Trustee consolidates with, merges or converts into, or transfers all or substantially all of its corporate trust business to, another corporation or national banking association, the resulting, surviving or transferee corporation or national banking association without any further act will, if such resulting, surviving or transferee corporation or national banking association is otherwise eligible under this Indenture, be the successor Trustee with the same effect as if the successor Trustee had been named as the Trustee in this Indenture.

Successor Trustee by Xxxxxx. If the Trustee consolidates with, merges or converts into, or transfers all or substantially all of its corporate trust business to, another corporation corporation, or national banking association, the resulting, surviving or transferee successor corporation or national banking association without any further act will, if such resulting, surviving or transferee corporation or national banking association is otherwise eligible under this Indenture, shall be the successor Trustee with the same effect as if the successor Trustee had been named as the Trustee in this IndentureTrustee, subject to Section 7.10.

Successor Trustee by Xxxxxx. If the Trustee consolidates with, merges or converts into, or transfers all or substantially all of its corporate trust business (including its obligations under this Indenture) or assets to, another corporation or national banking association, the resulting, surviving or transferee corporation or national banking association without any further act will, if shall be the successor Trustee; provided that such resulting, surviving or transferee corporation or national banking association is Person shall be otherwise qualified and eligible under this Indenture, be the successor Trustee with the same effect as if the successor Trustee had been named as the Trustee in this IndentureArticle VII.

If the Trustee consolidates with, merges or converts into, or sells or transfers all or substantially all of its corporate trust business to, another corporation or national banking association, the resulting, surviving or transferee corporation or national banking association without any further act will, if such resulting, surviving or transferee corporation or national banking association is otherwise eligible under this Indenture, will be the successor Trustee with the same effect as if the successor Trustee had been named as the Trustee in this the Indenture.
