SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Borrower shall immediately notify Lender of the commencement, or receipt of notice, of any and all actions or proceedings or other material matter or claim affecting the Property and/or the interest of Lender under the Loan Documents (collectively, "Actions"). Borrower shall appear in and defend any Actions.
(b) Lender shall have the right, at the cost and expense of Borrower, to institute, maintain and participate in Actions and take such other action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Property and/or the interest of Lender under the Loan Documents. Any money paid by Lender under this Section shall be reimbursed to Lender in accordance with Section 11.06 hereof.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Trustor and/or Operating Lessee as applicable shall immediately notify Beneficiary of the commencement, or receipt of notice, of any and all actions or proceedings or other material matter or claim affecting the Property and/or the interest of Beneficiary under the Loan Documents (collectively, “Actions”). Trustor and/or Operating Lessee as applicable shall appear in and defend any Actions.
(b) Beneficiary shall have the right, at the cost and expense of Trustor, to institute, maintain and participate in Actions or other proceedings and take such other action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Property and/or the interest of Beneficiary under the Loan Documents. Any money paid by Beneficiary under this Section shall be reimbursed to Beneficiary in accordance with Section 11.6 hereof.

(a) Grantor shall immediately notify Beneficiary of the commencement, or receipt of notice, of any action or proceeding or other material matter or claim affecting the Property and/or the interest of Beneficiary under the Loan Documents (collectively, “Actions”). Grantor shall appear in and defend any Actions.
(b) Beneficiary shall have the right, at the cost and expense of Grantor, to institute, maintain and participate in Actions or other proceedings and take such other action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Property and/or the interest of Beneficiary under the Loan Documents. Any money paid by Beneficiary under this Section shall be reimbursed to Beneficiary in accordance with Section 11.6 hereof.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Mortgagor shall promptly notify Mortgagee of the commencement, or receipt of written notice, of any and all material actions or proceedings or other material claim affecting the Property or Mortgagor and/or the interest of Mortgagee under the Loan Documents, the Guaranty, or the Unsecured Indemnity Agreement (collectively, “Actions”). Mortgagor shall appear in and defend any Actions.
(b) Mortgagee shall have the right, at the cost and expense of Mortgagor, to institute, maintain and participate in Actions and take such other action, as it may deem appropriate in the good-faith exercise of its discretion to preserve or protect the Property and/or the interest of Mortgagee under the Loan Documents, the Guaranty, and the Unsecured Indemnity Agreement if Mortgagor has not instituted, maintained or participated in Actions in an appropriate manner as reasonably determined by Mortgagee. Any money paid by Mortgagee under this Section shall be reimbursed to Mortgagee in accordance with Section 11.06 hereof.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Mortgagor shall immediately notify Administrative Agent and the Secured Parties of the commencement, or receipt of written notice, of any and all actions or proceedings or other material matter or claim having a material adverse effect on the Mortgaged Property and/or the interest of Administrative Agent and the Secured Parties under the Loan Documents (collectively, “Actions”). Mortgagor shall appear in and defend any Actions.
(b) If in Administrative Agent’s good faith judgment Mortgagor is not adequately protecting the Mortgaged Property and/or the interest of Administrative Agent and the Secured Parties under the Loan Documents in connection with any Actions, (i) Administrative Agent shall have the right, after written notice, at the reasonable cost and expense of Mortgagor, to institute and maintain the Actions and take such other reasonable action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Mortgaged Property and/or the interest of Administrative Agent and the Secured Parties under the Loan Documents; and (ii) Administrative Agent shall have the right, at any time in its good faith judgment, to participate in any Action (at Mortgagor’s expense) to the extent necessary to preserve or protect the Mortgaged Property and/or the interest of Administrative Agent and the Secured Parties under the Loan Documents. Any money paid by Administrative Agent under this Section shall be reimbursed to Administrative Agent.

(a) Affiliated Guarantor and/or Operating Lessee as applicable shall immediately notify Beneficiary of the commencement, or receipt of notice, of any and all actions or proceedings or other material matter or claim affecting the Property and/or the interest of Beneficiary under the Security Documents (collectively, “Actions”). Affiliated Guarantor and/or Operating Lessee as applicable shall appear in and defend any Actions.
(b) Beneficiary shall have the right, at the cost and expense of Affiliated Guarantor, to institute, maintain and participate in Actions or other proceedings and take such other action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Property and/or the interest of Beneficiary under the Security Documents. Any money paid by Beneficiary under this Section shall be reimbursed to Beneficiary in accordance with Section 11.6 hereof..

Trustor shall appear in and defend any Actions.
(b) Beneficiary shall have the right, at the cost and expense of Trustor, to institute, maintain and participate in Actions or other proceedings and take such other action, as it may deem appropriate in the good faith exercise of its discretion to preserve or protect the Property and/or the interest of Beneficiary under the Loan Documents. Any money paid by Beneficiary under this Section shall be reimbursed to Beneficiary in accordance with Section 11.06 hereof.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Borrower shall promptly notify Lender of the commencement, or receipt of written notice, of any and all material actions or proceedings or other material claim affecting the Property or Borrower and/or the interest of Lender under the Loan Documents, the Guaranty, or the Unsecured Indemnity Agreement (collectively, “Actions”). Borrower shall appear in and defend any Actions.
(b) Lender shall have the right, at the cost and expense of Borrower, to institute, maintain and participate in Actions and take such other action, as it may deem appropriate in the good-faith exercise of its discretion to preserve or protect the Property and/or the interest of Lender under the Loan Documents, the Guaranty, and the Unsecured Indemnity Agreement if Borrower has not instituted, maintained or participated in Actions in an appropriate manner as reasonably determined by Lender. Any money paid by Lender under this Section shall be reimbursed to Lender in accordance with Section 11.06 hereof.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (k) The Issuer covenants and agrees to (and to cause each applicable PropCo to) appear in and defend any action or proceeding purporting to affect any Property, any other security afforded by any of the Collateral Documents and/or any interest of the Trustee or any Holder thereunder. The Issuer shall (and shall cause each applicable PropCo to) immediately notify Trustee of the commencement, or receipt of notice, of any such action or proceeding or other matter or claim purporting to, or which could, affect any Property, any other security afforded by any of the Collateral Documents and/or the interest of Trustee or any Holder thereunder.
(l) The Trustee, at the direction of the Required Holders, shall have the right, at the cost and expenses of the Obligor Parties, to institute and maintain such suits and proceedings and to take such other actions as it may deem expedient to preserve or protect any Property, any other security afforded by any of the Note Documents and/or the Trustee’s or any Holder’s interest therein.
SUITS AND OTHER ACTS TO PROTECT THE PROPERTY. (a) Grantor covenants and agrees to appear in and defend any action or proceeding purporting to affect the Property, any other security afforded by any of the Loan Documents and/or the interest of Beneficiary thereunder. Grantor shall immediately notify Beneficiary of the commencement, or receipt of notice, of any such action or proceeding or other matter or claim purporting to, or which could, affect the Property, any other security afforded by any of the Loan Documents and/or the interest of Beneficiary thereunder.
(b) Beneficiary shall have the right, at the cost and expense of Grantor, to institute and maintain such suits and proceedings and take such other action, as it may deem expedient to preserve or protect the Property, any other security afforded by any of the Loan Documents and/or Beneficiary's interest therein. Any money paid by Beneficiary under this Section 1.14(b) shall be reimbursed to Beneficiary in accordance with Section 3.10 hereof.
