Common use of Suits by Warrantholders Clause in Contracts

Suits by Warrantholders. Subject to Sections 7.1 and 8.11, any of the rights conferred upon a Warrantholder by the terms of the Warrants held by it and/or this Agreement may be enforced by such Warrantholder by appropriate legal proceedings but without prejudice to the right that is hereby conferred upon the Agent to proceed in its own name to enforce each and all of the provisions herein contained for the benefit of the holders of the Warrants from time to time outstanding.

Suits by Warrantholders. Subject to Sections 7.1 and 8.11Section 7.10, all or any of the rights conferred upon a Warrantholder by the terms of the Warrants held by it him and/or this Agreement Indenture may be enforced by such Warrantholder by appropriate legal proceedings but without prejudice to the right that is hereby conferred upon the Warrant Agent to proceed in its own name to enforce each and all of the provisions herein contained for the benefit of the holders of the Warrants from time to time outstanding.
