Common use of SunWater’s Duty Unaffected Clause in Contracts

SunWater’s Duty Unaffected. Where, under the Act, SunWater is to approve the amendment, transfer, seasonal water assignment or lease referred to in this clause, SunWater shall carry out its responsibility under the Act strictly in accordance with the terms of the Act and any other Law binding on it without regard to this Agreement.

SunWater’s Duty Unaffected. Where, under the Act, SunWater is to approve the amendment, transfer, seasonal water assignment lease, dealing with, change or lease dealing related to the Additional Contract referred to in this clause, the Customer acknowledges that SunWater shall is obliged to carry out its responsibility under the Act strictly in accordance with the terms of the Act and any other Law binding on it without regard to this Agreement.
