Common use of Super Top-Heavy Status Clause in Contracts

Super Top-Heavy Status. This Plan shall be a Super-Top-Heavy Plan for any Plan Year commencing after December 31, 1983, and prior to January 1, 2000, if, after first substituting the term 90% for the term 60% each time it appears in Section 8.02 (a), the Plan would meet the test for being a Top-Heavy Plan specified therein.
