Common use of Supplier to manage Product recall Clause in Contracts

Supplier to manage Product recall. (1) Any decision relating to a recall of the goods (including any decision relating to the initiation or implementation of or strategy relating to a recall of the goods) will be made at the discretion of the Supplier or, where the Supplier is not the Sponsor, the Sponsor unless otherwise directed by a relevant regulatory authority. (2) The Customer must not initiate, implement or take any action in relation to a recall of the goods without the prior consent of the Supplier or, where the Supplier is not the Sponsor, the Sponsor.
