Supply and Operating Shortfalls. For greater certainty and notwithstanding any other provision of this Agreement, the provisions of Article 6.6 outline the sole remedies for City Supply Failures and EGAB Acceptance Failures and neither party will be responsible for any other damages in any form with respect to City Supply Failures and EGAB Acceptance Failures unless such City Supply Failures and EGAB Acceptance Failures become an Event of Default as defined in Article 12.1b).
