Supply & Specifications Sample Clauses

Supply & Specifications. Buyer shall have the right of first refusal to purchase any and all Product produced by Seller for the price identified in Section 2(b). On the first day of each calendar month during the Term, Seller will provide Buyer the tonnage and specifications of Product set forth in Exhibit A that is available to sell to the Buyer. Buyer shall have up to ten (10) days to provide Seller with written notice of any quantity of Product the Buyer will buy for that calendar month, and S▇▇▇▇▇ agrees to sell said Product to Buyer. For purposes of this Agreement, all references to “ton” shall mean a metric tonne equivalent to 2,205 pounds. Seller represents the specifications of Product as set forth in Exhibit A (the “Specifications”).
