Surplus Materials. Any surplus materials, fixtures, articles or equipment remaining at the completion of the project shall become the property of the Contractor, except those items furnished by the Government, whose cost is not included in the contract price.
Surplus Materials. Contractor shall notify Owner or Owner’s Representative of any materials and equipment supplied to Contractor by Owner which are surplus and, without additional compensation, shall cooperate with Owner and Owner’s Representative in the disposition of such surplus as directed by Owner or Owner’s Representative.
Surplus Materials. Where the quantities of materials ordered are in excess of those used, such surplus material will not be accepted for refund, creditor exchange, irrespective of whether or not the quantities ordered were estimated by The Company.

Surplus Materials. The Operator shall make timely disposal of idle and surplus Material charged to the Joint Account.
Surplus Materials. At the end of the Project, any refund for surplus materials returned to suppliers, plus applicable sales tax savings amount, shall be credited as a deduction for any payment owed to the Construction Manager. Salvage materials shall be the property of the Owner and stored or removed from the site by the subcontractor at the Owner's direction.
Surplus Materials. All material not suitable for stockpiling as outlined in Section 300-2.2 of the Standard Specifications, which contain debris, shrubbery, asphaltic concrete, Portland Cement concrete or other deleterious material shall become the property of the Contractor. Surplus material encountered in a manner not associated with regular on-going maintenance activities shall be subject to removal at time and material basis upon approval by the Authority. Material shall be disposed of at a legally acceptable disposal site furnished by the Contractor and shall be considered as included in the lump sum contract bid price for and no additional compensation will be made therefor.
Surplus Materials. All surplus materials used within the works remain the full property of Vitality Kitchens & Joinery unless otherwise stated in the contract of works.
Surplus Materials. Any surplus materials remaining after completion of the Project shall belong to the Contractor. No credits are due to the Customer. All material removed from structures in course of altera- tion/remodeling shall be disposed of by the Contractor except those items designated by the Customer, in writing, prior to commencement of the Project.
Surplus Materials. It is understood that in performing work of the scope and complexity of the Work to be performed hereunder, it is necessary and inevitable that certain surplus material be purchased. Contractor shall, as soon as it is feasible to do so, determine and advise Owner what materials are surplus. Owner shall have the right to purchase any or all such materials at a mutually agreed upon price. Should Owner elect not to purchase any or all of the surplus material, Contractor shall remove (in conformity with Applicable Laws) such material from the Job Site as soon as practicable.
