Common use of Surrender of Warrants Clause in Contracts

Surrender of Warrants. The Company shall have received in physical form or through book-entry transfer from the Holder all certificates or book-entry notation representing the Warrants to be exchanged for the Exchange Note; provided, that the foregoing shall be deemed to have been satisfied by instructions from the Company to its transfer agent to cancel the Warrants upon confirmation of delivery of the Exchange Note.
