SURROGATE PARENTS AND XXXXXX YOUTH. CONTRACTOR shall recognize an LEA surrogate parent assignments for students without parental representation, including unaccompanied homeless youths, in special education procedures pursuant to California Government Code Section 7579.5. Surrogate parents shall serve as the child’s parent and have all the rights relative to the student's education that a parent has under the Individuals with Disabilities Education Act pursuant to 20 USC 1414-1482 and 34 CFR 300.1- 300.756. A pupil in xxxxxx care shall be defined pursuant to California Education Code section 42238.01(b). The LEA shall annually notify the CONTRACTOR who the LEA has designated as the educational liaison for xxxxxx children. When a pupil in xxxxxx care is enrolled in an NPS by the LEA any time after the completion of the pupil’s second year of high school, the CONTRACTOR shall schedule the pupil in courses leading towards graduation based on the diploma requirements of the LEA unless provided notice otherwise in writing pursuant to Section 51225.1. In accordance with the Xxxxxx Youth Education Rights Act (A.B. 723), the CONTRACTOR agrees to both serve as the school of origin (for the duration of the jurisdiction of the court) of the xxxxxx youth and allow the xxxxxx youth to continue their education in the school, as applicable under Education Code section 48853.5.
