Common use of Survey Materials Clause in Contracts

Survey Materials. 3.1 If a Proficiency Testing Survey requires any specific Survey Materials (which, for clarity, may also be referred to as Product(s)), such Survey Materials will be shipped to the Customer at the address as identified in the Quotation, or such other address as may be notified in writing by the Customer no later than seven (7) days prior to the applicable scheduled shipment date (“Delivery Address”). Any such change of Delivery Address shall only apply to future deliveries of Survey Materials. The delivery of Survey Materials is “as is” and “when available” and the Customer’s participation in the Proficiency Testing Responsible: Team Lead, Client Relations and Operational Support Authorized by: Director, Proficiency Testing Version Date: 2021-08-12 Survey is dependant on, in IQMH’s sole opinion, the availability of the applicable Survey Materials and a suitable means of transportation/shipping, and any applicable import or export customs clearances. 3.2 The Customer agrees to comply, and cause Customer Personnel to comply, with the handling, storage, use and other information (which in certain cases may include Intellectual Property rights) as notified in writing on the labels and/or inserted documentation contained in/on the package or packaging of the Survey Materials (collectively, “Packaging Information”). IQMH shall not be liable hereunder for any act or omission or negligence related to the Customer’s, or Customer Personnel’s, non- compliance with the Packaging Information.
