Common use of Survival; No Limitation Clause in Contracts

Survival; No Limitation. The indemnification obligations of each Party under this Article 10 shall continue in full force and effect regardless of whether this Agreement has expired or been terminated or canceled and shall not be limited in any way by any limitation on insurance, on the amount or types of damages, or by any compensation or benefits payable by the Parties under any applicable workers' compensa­tion acts, disability benefit acts or other employee acts. INSURANCE General . The Parties agree to maintain at their own cost and expense, fire, liability, workers' compensation, and other forms of insurance relating to their property and facilities in the manner and amounts set forth in Schedule E, as both Parties may from time to time agree to amend. A Party may utilize self insurance to the extent such self insurance is consistent with then current industry practice, and all deductibles, self-insured amounts under any insurance set forth in Schedule E shall be for the account of the Party placing the insurance.
