Common use of Survival Provision Clause in Contracts

Survival Provision. If any benefits provided under this Agreement are still owed, or claims pursuant to this Agreement are still pending, at the time of termination of this Agreement, this Agreement shall continue in force, with respect to those obligations or claims, until such benefits are paid in full or claims are resolved in full. Sections 6, 7, 8, 9, 10 and 11 of this Agreement shall survive termination of this Agreement and shall be enforceable regardless of any claim Executive may have against PremierWest.

Survival Provision. If any benefits provided under this Agreement in Sections 5.1, 5.3, 5.4, 8 or 9 are still owed, or claims pursuant to this Agreement are still pending, owed at the time of termination of this Agreement, this Agreement shall continue in force, with respect to those obligations or claims, until such benefits are paid in full or claims are resolved in full. In addition, Sections 6, 7, 8, 9, 10 and 11 through 19 of this Agreement shall survive after termination of this Agreement Agreement, and shall be enforceable regardless of any claim Executive Officer may have against PremierWestUmpqua and its affiliates.
