Surviving Charter Sample Clauses
Surviving Charter. The Articles of Incorporation of Subsidiary, in the form attached as Exhibit K hereto, shall be from and after the Effective Time, the Surviving Charter until amended as provided in the Surviving Charter or by applicable Laws.
Surviving Charter. The articles of amendment and restatement of declaration of trust of the Company in effect immediately prior to the REIT Effective Time shall be, from and after the REIT Effective Time, the declaration of trust of the Surviving Entity (the “Surviving Charter”), until duly changed or amended as provided therein or in accordance with applicable Law.
