Common use of Suspension of Supply Clause in Contracts

Suspension of Supply. In addition to the rights and indemnification to which the Seller is entitled, if the Buyer fails to perform any of its payment obligations under this Agreement or any of its obligations relating to the bank guarantee defined in Section 7.4, the Seller shall be entitled to terminate electricity deliveries not earlier than on the third Calendar Day following its written notice sent to the Buyer until the date when the Buyer fully meets all of its due obligations (including the payment of all default interest and other incidental charges payable pursuant to this Agreement or the Laws). The Seller shall be exempted from the obligation to supply the electricity undelivered during the period of suspension, that is, the Seller is not obliged to make up for the quantity of electricity undelivered during the period of suspension even after the possible restart of supply.
