Suspension of the Right of Repurchase Sample Clauses
The Suspension of the Right of Repurchase clause temporarily halts a party's ability to buy back an asset or property that was previously sold or transferred. In practice, this clause may be triggered by specific events such as a breach of contract, insolvency, or regulatory intervention, during which the seller cannot exercise their repurchase rights until the suspension is lifted. Its core function is to protect the interests of the buyer or other stakeholders by preventing the repurchase process during periods of uncertainty or risk, thereby ensuring stability and clarity in the transaction.
Suspension of the Right of Repurchase. The Trustees may declare a suspension of the right of repurchase or postpone the date of payment as permitted under the 1940 Act. Such suspension shall take effect at such time as the Trustees shall specify and thereafter there shall be no right of repurchase or payment until the Trustees shall declare the suspension at an end. In the event that the Trust is divided into Classes, the provisions of this Section 7.5, to the extent applicable as determined in the discretion of the Trustees and consistent with the 1940 Act, may be equally applied to each such Class.
