Common use of Suspension without Cause Clause in Contracts

Suspension without Cause. Owner may, at any time and without cause, suspend the Work or any portion thereof for a period of not more than ninety (90) days by written notice to Contractor, which will fix the date on which Work will be resumed. Contractor shall be allowed an increase in the Contract Sum or an extension of the Contract Time, or both, directly attributable to any suspension if Contractor makes an approved claim therefor.

Suspension without Cause. The Owner shall communicate to the Contractor such suspension in writing. The Owner shall indicate in the notice to Contractor, which will fix of suspension the date on which of resumption of the Work will be resumed. Contractor shall be allowed an increase and the corresponding adjustment in the Contract Sum or an extension of the Contract Completion Time, or bothwhich shall not be less than the period of suspension, directly attributable to any suspension if Contractor makes an approved claim thereforand adjustment in Contract Price as may be deemed applicable.
