Switch Licensed Materials. (a) Customer may transfer its right-to-use 5ESS(R) Switch Software furnished under this Agreement without the payment of an additional right-to-use fee by transferee, except where size sensitive units are a factor. Such transfer can be made to an end user for their own internal use and only under the following conditions:
