Common use of Taking - Lease Ends Clause in Contracts

Taking - Lease Ends. If at any time during the Term the whole of the Premises shall be taken for any public or quasi-public use, under any statute or by right of eminent domain, this Lease shall terminate on the date of such taking, except as provided in Subsection 5.2.3. If less than all of the Premises shall be so taken and in Tenant’s reasonable opinion the remaining part is insufficient for the conduct of Tenant’s business, then Tenant may, by notice to Landlord within sixty (60) days after the date Tenant is notified of such taking, terminate this Lease. If Tenant exercises its option, this Lease and the Term shall end on the date specified in Tenant’s notice and the Base Rent and Additional Rent shall be apportioned and paid to the date specified in Tenant’s notice.

If at any time during the Term the whole of the Leased Premises shall be taken for any public or quasi-public use, under any statute or by right of eminent domain, this Lease shall terminate on the date of such taking, taking except as provided in Subsection 5.2.3Section 12.03. If less than all of the Leased Premises shall be so taken and in Tenant’s 's reasonable opinion the remaining part is insufficient for the conduct of Tenant’s business, then 's business Tenant may, by notice to Landlord within sixty (60) days after the date Tenant is notified of such taking, terminate this Lease. If Tenant exercises its option, this Lease and the Term shall end on the required date specified in Tenant’s notice of delivery of the condemned area to the condemning authority and the Base Annual Rent and Additional Rent shall be apportioned and paid to the date specified in Tenant’s 's notice.
