Technical Conciliation Committee. 43.1. The Technical Conciliation Committee will be formed within fifteen (15) Business Days following its convocation by any of the Parties and will be composed of three
Technical Conciliation Committee. The Technical Conciliation Committee should be installed within fifteen (15) Working Days following its convocation by any of the Parties, and will consist of three (3) members who are qualified on the matter to be discussed. Each of the Parties will select one (1) member, and the third member will be selected by the members designated by the Parties. If any of the Parties fails to designate its respective member within the term stipulated above, or if the members designated by the Parties cannot agree on the designation of the third member, within the period stipulated above, or if the Technical Conciliation Committee does not issue any opinion within the period stipulated, then any of the Parties may submit the discrepancy to be resolved in accordance with the stipulations contained in Article 21.3 of this Contract. The Parties should agree on the procedures that will govern the Technical Conciliation Committee within sixty (60) Days from the Date of Subscription. The resolutions of the Technical Conciliation Committee must be issued within thirty (30) Days of their installation and will have an obligatory character, unless an arbitration decision, if that is the case, does not resolve the difference in final form. Without interfering with compliance with the resolution issued by the Technical Conciliation Committee, any of the Parties may choose to use arbitration, as established in Article 21.3 of this Contract, within sixty (60) Days following receipt of the notification transmitting the Committee's resolution mentioned above.
Technical Conciliation Committee. The Technical Conciliation Committee will convene within fifteen (15) Business Days after it has been convoked by any of the Parties and will sit three (3) qualified members with expertise in the topic to be addressed. Each of the Parties will choose one (1) member and the third member will be appointed by those members already designated by the Parties. If either of the Parties fails to designate its representative within the foreseen period or if the designated members fail to agree on the third member within the foreseen period or if the Technical Conciliation Committee fails to issue an opinion within the foreseen period, either of the Parties may submit the discrepancy for resolution pursuant to provisions under heading 21.3 under this Agreement. Within sixty (60) days starting on the Date of Signing, The Parties will agree on the procedure to be followed by this Committee. The Technical Conciliation Committee’s resolutions must be issued within thirty (30) days after its inauguration and will be mandatory until a final arbitration decision, if such procedure is invoked, is issued. Notwithstanding compliance with the decision issued by the Technical Conciliation Committee any of the Parties may have recourse to arbitration pursuant to heading 21.3 within sixty (60) days after the date when the above-mentioned decision was notified and received.
Technical Conciliation Committee. The Technical Conciliation Committee shall meet no later than fifteen (15) Business Days after being called by either Party and shall consist of three.(3) members qualified in the subject under discussion. Each of the Parties shall select one (1) member and the third by the members appointed by the Parties. If either Party fails to nominate its representative within the time allowed, or if the members nominated by them cannot agree on the third member within the time allowed, or if the Technical Conciliation Committee fails to reach a decision within the time allowed, either Party may submit the discrepancy to arbitration as set forth in section 21.3 of the Contract. The Parties shall agree on the procedures which are to govern this Committee no later than sixty (60) Days after the Signature Date. The decisions of the Technical Conciliation Committee shall be published no later than thirty (30) Days after it has been installed and shall be binding until an arbitration tribunal, if applicable, arrives at a final decision. Without affecting compliance with the decision of the Technical Conciliation Committee, either Party may resort to arbitration in accordance with the provisions of section 21.3, within sixty (60) Days after the date of receipt of the above mentioned decision.
