TECHNICAL WARRANTY. 1. The Second Party warrants that for 12 months from the date of delivery, should any defect ,problems that may arise in part or all of the supply, originating from faulty materials or faulty workmanship employed by the Second Party or by any of its suppliers or subcontractors, it shall remedy such defect by repair or replacement, at its discretion, following the return of the faulty materials. 2. The Second Party is not responsible in any of the following circumstances: a. If the Supplies concerned have not been operated, maintained, transported or stored in accordance with the Second Party’s manuals, documentation or written recommendations; b. If the relevant details of the faulty Supply (or the faulty part thereof) have not been properly recorded at the right time in the relevant log book, and/or they are not given to the Second Party when requested; c. If the faulty Supply (or faulty part thereof) has not been stored, repaired or altered in accordance with the Second Party’s written instructions; d. If the Supplies in question have been subjected to abnormal conditions or misuse, or have previously suffered an accident; e. If any component supplied by the Second Party has been replaced, repaired or in other ways been affected by another component not supplied by the Second Party or by the First Party’s or a third party’s actions. f. Reasonable wear and tear. 3. It is expressly understood that a component shall not be considered faulty simply because its useful life or time between repairs has been shortened by an order or on the recommendation of the proven competent authority. 4. The Second Party shall not be liable to the First Party for any direct or indirect damage, expenses or costs, allegedly or demonstratably incurred regardless of the cause, by loss, or loss of use, of any of the supplies or their components.
TECHNICAL WARRANTY. Piristeel Oy guarantees that, with the limitations men- tioned in this document, no rust-through caused by oxida- tion will occur in the powder-coated or paint-coated prod- ucts during the warranty period. • Rainwater systems refer to paint-coated parts of rain- water systems manufactured by Piristeel Oy. • Roof safety products refer to powder-coated ladders, roof walkways, snow guards, safety equipment and fas- tenings related to them, manufactured by Piristeel Oy. The warranty does not apply to damage caused during transport or by incorrect or imprudent storage, installation or other handling of the product, for example. • The warranty is not valid if the installation is supple- mented with products/parts/components not sup- plied by Piristeel Oy. • The warranty does not apply to backside coating or corrosion caused by damage to the backside coating (rainwater systems). • The warranty does not apply to any corrosion originat- ing from pipe interior. • The warranty does not apply to products that are damaged as a result of chemical or mechanical stress. • The warranty does not apply to cut edge corrosion that starts from a hole or unprotected cut edges on products. • The warranty is only valid for products that are used at elevations less than 900 metres above sea level. • The warranty does not apply to products that are in- stalled less than 200 metres from the sea shore. • The warranty does not cover damage that is caused by continuous exposure to temperatures of over 60 degrees Celsius. • The warranty does not apply to a product that is in constant contact with water, mortar, wet wood or soil, for example, or the surface of which may be affected by corrosive chemicals and steam, condensation wa- ter or ash, w...

TECHNICAL WARRANTY. The Contractor warrants that the Works and the Deliveries, including all repairs, are free from any defects and will achieve any performance requirements stipulated in the Contract and that they in all other aspects satisfy the relevant specifications, drawings, standards and regulations listed in the Contract. Further, the Contractor warrants that the Deliveries can be utilised in accordance with their intended use and that they at the time of the PTO for each Trainset satisfy all applicable laws and regulations or other requirements imposed by any relevant official authority. This warranty shall commence at PTO for each Trainset and apply to all faults and deficiencies discovered until 2 years after the FTO of each Trainset. The warranty, including the extended warranty following clause 12.2, shall not apply for normal wear and tear or for faults/deficiencies caused by non- compliance with maintenance obligations.

  • General Warranty Vendor warrants that the Services will be performed and delivered in a professional, first-class manner in accordance with this Agreement and the standards prevailing in the industry. To this end, Vendor will undertake the following actions without additional consideration during the term of this Agreement and for one (1) year thereafter: (a) promptly make necessary revisions or corrections to resolve any errors and omissions on the part of Vendor; and, (b) confer with Citizens as Citizens deems appropriate for the purpose of interpreting any of the Services or information furnished. Acceptance of or payment for the Services by Citizens shall not relieve Vendor of these responsibilities. The warranties and covenants in this Section will extend to and bind Vendor’s subcontractors, if any.

  • Mutual Warranty Each party represents and warrants that it has the legal power and authority to enter into this Agreement.

  • Manufacturer’s Warranty The Goods include the manufacturer’s standard limited parts warranty to replace defective parts covered under such warranty exclusive of labor. Labor is warranted by the Elevator Contractor for 90 days following installation. The manufacturer’s parts warranty may require that the Goods be maintained throughout the warranty period by an authorized manufacturer’s representative under a separate maintenance contract. Any warranty is conditioned on written notice to the Elevator Contractor within warranty period and contingent upon receipt of final payment to Elevator Contractor.

  • General Warranties Seller warrants that (a) Goods are new and do not contain any used or reconditioned parts or materials, unless otherwise specified or approved by AGILENT; (b) Goods are manufactured by or for the original manufacturer and do not contain any counterfeit materials. (c) Goods and results of the Services do not use or incorporate any freeware, shareware or open source software, unless otherwise specified or approved by AGILENT; and (d) all Services shall be performed in a professional manner.

  • Additional Warranties Where Contractor, product manufacturer or service provider generally offers additional or more advantageous warranties than set forth below, Contractor shall offer or pass through any such warranties to Authorized Users.   • No Additional Warranty Nothing in this Article XII shall be construed or deemed to (i) expand or otherwise alter any warranty or disclaimer thereof provided under Section 3.3 or any other provision of this Agreement with respect to, among other matters, the title, value, collectibility, genuineness, enforceability or condition of any (x) Asset, or (y) asset of the Failed Bank purchased by the Assuming Bank subsequent to the execution of this Agreement by the Assuming Bank or any Subsidiary or Affiliate of the Assuming Bank, or (ii) create any warranty not expressly provided under this Agreement with respect thereto.
