Telephonic and Electronic Communications. In addition to the provisions set forth in the Guides, the PFI hereby authorizes the Bank, from time to time without notice to the PFI, to record telephonic and other electronic communications of the PFI with the Bank.
Telephonic and Electronic Communications. UBEM has a company policy in effect with regard to all telephonic and electronic communications, whether said communications are outgoing or incoming. Some UBEM business telephones and other electronic communications systems are customized with centralized recording devices for purposes of improving customer service, improving techniques, eliminating errors and general quality control. Communication systems used primarily to negotiate the sale or purchase of commodities or to discuss commodity futures transactions are recorded and other communications may be recorded.
Telephonic and Electronic Communications. As an accommodation to Borrowers, Lender may permit telephonic or electronic requests for loans and electronic transmittal of instructions, authorizations, agreements or reports to Lender by Borrowers. Unless Borrowers specifically direct Lender in writing not to accept or act upon telephonic or electronic communications from Borrowers, Lender shall have no liability to either Borrower for any loss or damage suffered by either Borrower as a result of Lender’s honoring of any requests, execution of any instructions, authorizations or agreements or reliance on any reports communicated to it telephonically or electronically and purporting to have been sent to Lender by either Borrower and Lender shall have no duty to verify the origin of any such communication or the authority of the person sending it.
