Common use of Temporary Space Clause in Contracts

Temporary Space. Landlord and Tenant hereby agree that Landlord shall provide Tenant with temporary space in the Building known as Suite 3787 and consisting of approximately 11,070 rentable square feet, as identified on Exhibit F, attached hereto (the “Temporary Space”) on a month-to-month basis from April 1, 2013 through January 31, 2014. The Temporary Space shall be leased to Tenant rent-free. Tenant accepts the Temporary Space “as-is” without representation or warranty by Landlord of any kind and with the understanding that Landlord shall have no responsibility with respect thereto. Tenant (at its sole cost and expense) shall obtain an occupancy permit from the applicable governing authority prior to occupying the Temporary Space. Tenant shall obtain in its own name and pay directly to the appropriate supplier the cost of all utilities and services serving the Leased Premises. During Tenant’s occupancy of the Temporary Space, the Temporary Space shall be considered a part of the Leased Premises for all purposes except for the calculation of Minimum Annual Rent, Monthly Rental Installments and Tenant’s Proportionate Share. Upon the expiration or earlier termination of Tenant’s lease of the Temporary Space, Tenant shall restore the Temporary Space to the condition that existed prior to Tenant’s occupancy of the same. The Temporary Space shall be subject to all other terms and conditions of this Lease not specifically addressed herein.

Temporary Space. Landlord At the request of Tenant, the parties have agreed that Tenant shall lease and Tenant hereby agree that Landlord shall provide Tenant with occupy on a temporary space basis approximately 2,256 square feet of Rentable Area in Suite 370 of the Building known as Suite 3787 and consisting of approximately 11,070 rentable square feet, as identified on Exhibit F, attached hereto (the “Temporary Space”), as generally outlined in Exhibit B-1 attached hereto. Accordingly, Landlord leases to Tenant and Tenant leases from Landlord the Temporary Space for a term commencing on the date that Tenant takes possession of the Temporary Space (the “Temporary Space Commencement Date”) and expiring on a month-to-month basis from April 1, 2013 through January 31, 2014the Commencement Date (the “Temporary Space Term”). The Temporary Space shall be leased available to Tenant rent-free. within two (2) business days after the date this Lease is fully executed and Tenant accepts delivers to Landlord the Temporary Space “as-is” without representation first month’s advance rent as required under Section 5.2, the Letter of Credit (or warranty by Landlord of any kind and with the understanding that Landlord shall have no responsibility with respect thereto. Tenant (at its sole cost and expense) shall obtain an occupancy permit from the applicable governing authority prior to occupying the Temporary Space. Tenant shall obtain in its own name and pay directly to the appropriate supplier the cost of all utilities and services serving the Leased Premises. During Tenant’s occupancy cash Security Deposit pending delivery of the Temporary SpaceLetter of Credit), certificates of insurance satisfactory to Landlord evidencing the Temporary Space shall insurance required to be considered a part of the Leased Premises for all purposes except for the calculation of Minimum Annual Rent, Monthly Rental Installments and Tenant’s Proportionate Sharecarried by Tenant under this Lease. Upon the expiration or earlier termination of Tenant’s The lease of the Temporary Space, Tenant shall restore the Temporary Space to the condition that existed prior to Tenant’s occupancy of the same. The Temporary Space shall be subject to all other terms and conditions provisions of this Lease, except as provided in this Section 3.5. During the Temporary Space Term and as applicable to the lease of the Temporary Space, all references in this Lease not specifically addressed hereinto the Leased Premises shall mean the Temporary Space. Prior to occupying or using all or any portion of the Temporary Space, Tenant shall deliver to Landlord the certificates of insurance required under this Lease.
