Tenant's Negligence. Anything contained in any provision of this Lease to the contrary notwithstanding, if any damage to the Premises, the Building and/or the Property is caused by or results from the negligent or intentionally tortious act or omission of Tenant, those claiming under Tenant or any of their respective officers, employees, agents or invitees, (a) the Rent shall not be suspended or apportioned as aforesaid, and (b) except if and to the extent that Tenant is released from liability therefor pursuant to the provisions of subsection 4.4, Tenant shall pay to Landlord upon demand, as Additional Rent, the cost of (i) any repairs and restoration made or to be made as a result of such damage, or (ii) (if Landlord elects not to restore the Building) any damage, expense or loss which Landlord may incur as a result of such damage.
