Common use of Tenant’s Notices Clause in Contracts

Tenant’s Notices. In the event of any act or omission by Landlord under this Lease which would give Tenant the right to terminate this Lease, or to claim a partial or total eviction, Tenant will not exercise any such right until: (a) it has given thirty days written notice (by United States certified or registered mail, postage prepaid) of such act or omission to the holder of any mortgage or deed of trust on the Property (whose names and addresses Landlord agrees will be furnished to Tenant on request) with a copy to Xxxx X. Xxxxx, Xxxxxx & Xxxxx, P.C., X.X. Xxx 0000, Xxxxxxx, Xxxxxxxx 00000; and X’Xxxxxx Development, 0000 Xxxxxxx Xxxxx, Xxxxx 000, Xxxxxxx, Xxxxxxxx 00000; and (b) any holder of any mortgage or deed of trust on the Property shall, following the giving of such notice, have failed with reasonable diligence to commence and to pursue reasonable action to remedy the act or omission.

In the event of any act or omission by Landlord under this Lease which would cause Landlord to be in default or give Tenant the right to terminate this Lease, Lease or to claim a partial or total eviction, Tenant will not exercise any such right until: (a) a. it has given thirty (30) days written notice (by United States certified or registered mail, postage prepaid) of such act or omission to Landlord and to the holder of any mortgage or deed of trust on the Property (whose names and addresses Landlord agrees will be furnished to Tenant on request) with a copy to Xxxx X. XxxxxXxxxx Xxxxxxxx, Xxxxxx & Xxxxx0000 Xxxxxxx Xxxxxx, P.C., X.X. Xxx Xxxxx 0000, XxxxxxxXxxxxx, Xxxxxxxx 00000; and X’Xxxxxx Development, 0000 Xxxxxxx Xxxxxor such other person as Landlord may designate, Xxxxx 000in writing, Xxxxxxx, Xxxxxxxx 00000from time to time; and (b) b. any holder of any mortgage or deed of trust on the Property shall, following the giving of such notice, have failed with reasonable diligence to commence and to pursue reasonable action to remedy the act or omissionomission within sixty (60) days of such notice.
