Common use of Term and Termination of Agreement Clause in Contracts

Term and Termination of Agreement. This Agreement shall continue in effect through April 30, 2015, and from year to year thereafter provided each such continuance is specifically approved by a majority of the Trustees of the Trust. This Agreement shall terminate automatically upon the termination of the Advisory Agreement. The Adviser may elect in its discretion to terminate this Agreement for any period following the term period of this Agreement, but no such termination shall affect the obligation (including the amount of the obligation) of the Fund to repay amounts of waived fees or reimbursed expenses with respect to periods prior to such termination.

This Agreement shall terminate automatically with respect to the applicable Fund upon the termination of its Advisory Agreement with the Advisory Agreement. The Adviser may elect in its discretion to terminate this Agreement for any period following the term period of this Agreement, but no such termination shall affect the obligation (including the amount of the obligation) of the Fund to repay amounts of waived fees or reimbursed expenses with respect to periods prior to such terminationAdviser.

This Agreement shall terminate automatically unless the Adviser provides written notice of the extension of this Agreement to the Trust at least 10 days prior to the end of the then-current term. In addition, this Agreement shall terminate upon the termination of the Advisory Agreement. The Contract, or it may be terminated by the Trust, without payment of any penalty, upon ninety (90) days’ prior written notice to the Adviser may elect in at its discretion to terminate this Agreement for any period following the term period principal place of this Agreement, but no such termination shall affect the obligation (including the amount of the obligation) of the Fund to repay amounts of waived fees or reimbursed expenses with respect to periods prior to such terminationbusiness.

This Agreement shall terminate automatically upon the termination of the Advisory Agreement.
