Term, Termination by Mutual Consent. Subject to the provisions of Section 7.02, the term of this Agreement shall run until the end of the Commitment Period; provided that the right of the Company to effect any Draw Downs under this Agreement may be terminated at any time by mutual consent of the parties. Notwithstanding the foregoing, the Company may terminate this Agreement at any time provided that, simultaneously with such termination, it shall make any payment required by Section 9.13.
