Common use of Termination by BII for Discontinuation Clause in Contracts

Termination by BII for Discontinuation. BII shall have the right, at any time, to terminate this Agreement if BII, or its Affiliates decide, at their sole discretion, to discontinue BII’s or its Affiliates’ activities with regard to the [***] Program, including without limitation the discontinuation of research, development or commercialization of the Acquired Assets and/or BII Products, upon [***] days prior written notice to MABVAX.
