Termination by Mitigation Partner. The Mitigation Partner may terminate this MOA upon thirty (30) days written notice to the Commonwealth and MVP, in which event the Mitigation Partner shall deliver to MVP, immediately upon termination, all remaining funds that are unobligated as of the date of termination. In no event shall the amount of remaining funds to be returned be less than the amount that the Mitigation Partner would be required to return under the Agreement if MVP had terminated the Project.
