Common use of Termination by Xxxxxxx Clause in Contracts

Termination by Xxxxxxx. Grantor may terminate this Agreement at its sole discretion upon 60 days advance written notice to Grantee. If this Agreement is so terminated, Grantor shall be liable only for payment required under the terms of this Agreement for performance of the Project prior to any reasonable non-cancellable obligations incurred by Grantee in performance of the Project prior to the effective date of termination. In the event of termination of the Project, or of this Agreement by Grantor, Grantor shall be entitled to take title and possession of any equipment purchased by Grantee for the Project with funding provided under this Agreement.
