Common use of Termination Due to Death Clause in Contracts

Termination Due to Death. In the event of Executive’s death during the Term of Employment, Executive’s employment hereunder shall be terminated and Executive’s estate shall be entitled to the Accrued Obligations earned through the Termination Date.

Termination Due to Death. In the event of the Executive’s death during 's employment is terminated due to his death, his estate or his beneficiaries, as the Term of Employmentcase may be, Executive’s employment hereunder shall be terminated and Executive’s estate shall be entitled to: (i) Base Salary through the date of death; (ii) the right to exercise any Stock Option which was exercisable at the date of the Executive's death for a period of one (1) year following the Executive's death; (iii) any amounts earned, accrued or owing to the Accrued Obligations earned through Executive but not yet paid; and (iv) other benefits in accordance with applicable plans and programs of the Termination DateCompany.

In the event of the Executive’s 's death during the Term of Employmentthis Agreement, the Executive’s 's employment hereunder shall be terminated immediately and Executive’s estate automatically terminate, and the Company shall be entitled have no further obligation or duty to the Accrued Obligations Executive or his estate or beneficiaries other than for all earned but unpaid compensation through the Termination Datedate of termination, as delineated in Section 7 (i) - (v) only, and other than as required by applicable law.
