Upon material breach, the aggrieved Party Either party may terminate this Agreement provided that (including the breaching Party Statement of Work) if the other party breaches any material term of this Agreement and, if curable, fails to cure the such breach within 30 thirty (30) days after receipt of following written notice. This remedy is in addition to any other remedies available at lawnotice thereof from the non-breaching party.

Termination for Breach. Upon material breach, the aggrieved Either Party may terminate this Agreement, or suspend performance under this Agreement provided that upon written notice to the breaching other Party fails to cure at any time during the term of this Agreement, if the other Party is in material breach of a material term of this Agreement and has not cured such material breach, if capable of cure, within 30 ninety (90) days after receipt notice requesting cure of written notice. Such termination of this Agreement will take effect if, after ten (10) days of such written notification, such breach within 30 days after receipt of written notice.
