(a) Is convicted for violation of criminal statutes, civil standards, or any other offense indicating a lack of busi- ness business integrity or honesty that seriously and directly affects the responsibility of PurchaserContractor; including, but not limited to:
(i) Theft, forgery, bribery, embezzlement, falsification or destruction of records, making false statements, or receiving stolen property, any of which occurred in connection with obtaining, attempting to obtain, selling, trading, or processing public timber;
(ii) Fraud, criminal offenses, or violation of Fed- eral Federal or State antitrust laws, any of which occurred in con- nection connec- tion with obtaining, attempting to obtain, or performing a public contract or subcontract; or
(iii) Threatening, resisting, intimidating, or inter- fering interfering with Forest Officers engaged in, or on account of, the performance of their official duties involving the pro- tectionprotection, improvement, or administration of National Forest lands;
(b) Is convicted for violation of criminal statutes or civil standards, orders, permits, or other regulations for environmental envi- ronmental protection issued by a Federal agency, State agency, or political subdivision thereof in the con- duct conduct of operations oper- ations hereunder on National Forest lands, pursuant to B6.01GT.0.1;
(c) Has engaged in a pattern of activity that demon- strates demonstrates flagrant disregard for the terms of this contract, such as, but not limited to, repeated suspensions for breach pursuant to B9.3JT.3, causing undesignated timber meeting Utilization Utiliza- tion Standards to be unnecessarily dam- aged damaged or negligently or willfully cut, or causing other seri- ous serious environmental degradation or resource damage;
(d) Fails to comply with contract provisions related to nondiscrimination in employment; or
(e) Fails to remedy a breach of contract within time limits stated in B9.3JT.3. Damages due the United States for termination under this Subsection shall be determined pursuant to B9.4JT.4.

BT9.4 Damages for Failure to Cut or Termination for Breach. (a) In event of Purchaser's failure to cut designated timber on portions of Sale Area by Termination Date or termination for breach under BT9.31 , Forest Service shall appraise remaining Included Timber, unless termination is under BTS.22 or BTS.34. Such appraisal shall be made with the standard Forest Service method in use at time of termination.
