Common use of Termination for Disability of Employee Clause in Contracts

Termination for Disability of Employee. 7.1. Employee’s incapacity. If, as a result of Employee's incapacity to materially perform the Services required under this Agreement because of physical or mental illness, as evidenced by Employee having been absent from his duties for two consecutive months or for more than an aggregate of three months in any Contract Year, the Board may give Employee a Disability Notice, which will be the first step in the parties attempts to terminate or amend this Agreement with mutual consent.
