Termination for Failure of the Company to Achieve Restoration Schedule Following Force Majeure Event. If following a Force Majeure Event, the GOB terminates this Agreement in accordance with Section 11B.4(b), as a result of the Company’s failure to timely complete the Restoration as required in Section 11B.4(b), the GOB or its designee shall have the right, but shall not be required, to acquire all of the Company’s rights, title, and interests in and to the Facility; provided, that the GOB or its designee, upon such acquisition, pays the Company the compensation amount set forth in Row IV of the Compensation Table in Schedule 2. If the GOB does not elect to purchase the Facility upon the effective date of the termination, the GOB shall have no further obligations to the Company hereunder.
