Common use of Termination for Nonappropriation Clause in Contracts

Termination for Nonappropriation. 7.2.1 All payments and SERVICES provided under this Contract are contingent upon the availability of the necessary public funding, which may include various internal and external sources. In the event that Carson City does not acquire and appropriate the funding necessary to perform in accordance with the terms of the Contract, the Contract shall automatically terminate upon CITY’S notice to CONSULTANT of such nonappropriation, and no claim or cause of action may be based upon any such nonappropriation.
