TERMINATION IN CASE OF DEATH OR DISABILITY. In the event of the Executive's death or a complete physical or mental inability, confirmed by a licensed physician, to perform the services described in Section 3 above that continues for a period of one hundred twenty (120) consecutive days) ("Permanent Disability"), the Company may elect to terminate this Agreement, subject to continuation of the payments described in Section 10.
