TERMINATION IN WHOLE OR IN PART. The Translation Centre shall be entitled to terminate this contract in whole or in part with immediate effect by notification only and without recourse to the courts, if the Contractor: a) is bankrupt or being wound up, is having his affairs administered by the courts, has entered into an arrangement with creditors, has suspended business activities, or is in any analogous situation arising from a similar procedure provided for in national legislation or regulations; b) has been convicted of an offence concerning his professional conduct by a judgment which has the force of res judicata; c) has been guilty of grave professional misconduct proven by any means which the contracting authority can justify; d) has not met his obligations relating to the payment of social security contributions or taxes under the legislation of the country in which he is established; e) has been the subject of a judgment which has the force of res judicata for fraud, corruption, involvement in a criminal organisation or any other illegal activity detrimental to the Unions' financial interests; f) following another procurement procedure or grant award procedure financed by the Unions’ budget, has been declared to be in serious breach of contract for failure to comply with his contractual obligations; g) has made false, incomplete or incorrect statements or has failed to provide information in an attempt to obtain the contract or any benefit resulting therefrom, or where this was the effect of his action.
