Termination of Agreement in the Event of Litigation. QUALCOMM at its option may terminate the license from QUALCOMM to LICENSEE in the event that LICENSEE initiates any litigation against QUALCOMM or its Affiliates or against any other party with respect to QUALCOMM’s or its Affiliates’ products which includes any claim for intellectual property infringement and LICENSEE does not prevail on all such intellectual property infringement claims.
