Common use of Termination of Credit Facility Clause in Contracts

Termination of Credit Facility. The Credit Facility shall terminate on the earliest of (a) September 30, 2005, (b) the date of permanent reduction of the Aggregate Commitment in whole pursuant to Section 2.6 and (c) the date of termination by the Administrative Agent on behalf of the Lenders pursuant to Section 11.2(a).” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:

Termination of Credit Facility. The Credit Facility CREDIT FACILITY shall terminate on the earliest of of: (a) September 30May 31, 2005, 2000; (b) the date of permanent reduction of termination by the Aggregate Commitment in whole BORROWER pursuant to Section 2.6 Subsection 2.5.(a); and (c) the date of termination by the Administrative Agent ADMINISTRATIVE AGENT on behalf of the Lenders LENDERS pursuant to Section 11.2(aSubsection 11.2.(a).” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:

Termination of Credit Facility. The Credit Facility shall terminate on upon the earliest earlier of (a) September 30Xxxxx 00, 20050000, (bx) the date on which the indebtedness of the Borrower to the Lenders under the Amended and Restated Credit Agreement is $190,000,000 or less; (c) the date of permanent reduction of termination by the Aggregate Commitment in whole Borrower pursuant to Section 2.6 2.5(a) hereof; and (cd) the date of termination by the Administrative Agent on behalf of the Lenders pursuant to Section 11.2(a).” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:

Termination of Credit Facility. The Credit Facility shall terminate on the earliest of (a) September 30July 1, 20052000, (b) the date of permanent reduction of termination by the Aggregate Commitment in whole Borrower pursuant to Section 2.6 2.5(a) and (c) the date of termination by the Administrative Agent on behalf of the Lenders pursuant to Section 11.2(a).” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:

Termination of Credit Facility. The Credit Facility shall terminate on the earliest earlier of (ai) September 30, 2005, the Revolving Loan Termination Date; (bii) the date of permanent reduction of the Aggregate Commitment in whole pursuant to Section 2.6 and (c) the date of termination termination, whether automatically or by the Administrative Agent on behalf of the Lenders Revolving Credit Lenders, pursuant to Section 11.2(a11.2 (a); or (iii) on such prior date as the Borrower, by notice to the Agent, shall have repaid the Obligations in full.” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:

Termination of Credit Facility. The Credit Facility shall terminate on the earliest of (a) September 30May 28, 20052004, (b) the date of permanent reduction of termination by the Aggregate Commitment in whole Borrower pursuant to Section 2.6 2.5(a), and (cb) the date of termination by the Administrative Agent on behalf of the Lenders pursuant to Section 11.2(a).” (d) Section 9.3 of the Credit Agreement is hereby deleted in its entirety and the following Section 9.3 shall be substituted in lieu thereof:
