Common use of Termination of Employment for Death or Disability Clause in Contracts

Termination of Employment for Death or Disability. If the Employee’s termination of employment occurs by reason of death or Disability (as defined below), in addition to the amounts payable and benefits provided under Section 5(a) above, the Company will pay the Employee (or his estate) a pro rata portion of any bonus payable under the PXXX, as the case may be, for the year in which such termination occurs determined based on the actual bonus attained for the fiscal year in which such termination occurs.
