Common use of Termination of Existing Agreement Clause in Contracts

Termination of Existing Agreement. The Existing Agreement is hereby terminated and replaced and superseded by this Agreement, effective August 1, 2001. All payments, of Base Salary or otherwise, made by the Company under the Existing Agreement with respect to any period commencing on or after August 1, 2001 shall be credited against the corresponding payment obligations of the Company under this Agreement.

Termination of Existing Agreement. The Existing Agreement is hereby terminated and replaced and superseded by this Agreement, effective August 1, 2001. All payments, of Base Salary or otherwise, made by the Company under the Existing Agreement (or under the Restated and Amended Employment Agreement dated October 6, 1997 which was replaced by the Existing Agreement), with respect to any period commencing on or after August 1, 2001 2001, shall be credited against the corresponding payment obligations of the Company under this Agreement.

Termination of Existing Agreement. The Existing Agreement is hereby terminated and replaced and superseded by this Agreement, effective August 1, 20012003. All payments, of Base Salary or otherwise, made by the Company under the Existing Agreement with respect to any period commencing on or after August 1, 2001 2003 shall be credited against the corresponding payment obligations of the Company under this Agreement.

Termination of Existing Agreement. The Existing Agreement is hereby terminated and replaced and superseded by this Agreement, effective August 1April 8, 20012002. All payments, of Base Salary or otherwise, made by the Company under the Existing Agreement with respect to any period commencing on or after August 1, 2001 shall be credited against the corresponding payment obligations of the Company under this Agreement.
