Common use of Termination of Prior Employment Agreement Clause in Contracts

Termination of Prior Employment Agreement. Executive's Employment Agreements with Post, Post LP and Services entered into on July 22, 1993, will terminate on the Effective Date, but Executive's Noncompetition Agreement with Post, Post LP and Services, entered into as of July 22, 1993 (the "Noncompetition Agreement"), shall not be affected by this Agreement and shall continue in full force and effect.

Termination of Prior Employment Agreement. Executive's Employment Agreements Agreement with Post, Post LP Holdings and Services entered into on July 22, 1993, June 1,1998 and as thereafter amended will terminate on the Effective Dateas of January 1, 2002, but Executive's Noncompetition Agreement with Post, Post LP Holdings and Services, entered into as of July 22, 1993 (the "Noncompetition Agreement")1993, shall not be affected by this Agreement and shall continue in full force and effect. Such Noncompetition Agreement and any successor to such agreement shall be referred to in this Agreement as the "Noncompetition Agreement."
